Introduction
The origins of many provisions of the Indian labor laws can be traced back to the British Raj. Formulated with the intent to protect the rights of the workers, the laws have now become convoluted and pose great challenges in implementation, overriding their benefits. In an effort to streamline and modernize the labor regulatory framework, the Government of India has repealed non-useful labor laws, codifying 29 labor laws into four comprehensive labor codes.
Advantages of the New Labor Codes
- Definition of Wages:
A standardized definition for wages was crucial as it directly impacts compensation policies and overall salary structures. The new codes adopt a uniform definition bringing clarity and consistency. It also facilitates the calculation of wages from a social security standpoint.
- Changes in EPF & Gratuity:
As a measure to improve post-retirement benefits for the workers, the new codes have increased contributions to EPF and gratuity. The alignment of the increased contributions with the revised basic pay provisions will enhance the financial security for employees.
- Fixed-Term Employment and Gig Workers:
Pros: Introduction and legal recognition to fixed-term employees and coverage of gig and platform workers has been provided in social security benefits. It recognizes and extends social security to a growing segment of workers.
Disadvantages of the New Labor Codes
- Implementation Challenges:
Many states are yet to formulate rules for the new codes. For the ones who have already formulated, there is substantial divergence, with a few even contradicting the fundamental principles of the codes, undermining the intended objectives.
- Impact on Salary Structures:
Changes in salary components, especially the 50% cap on allowances, may require organizations to revamp salary structures, increasing organizational costs in many cases.
- Increased power of hiring and firing:
The Code permits companies with upto 300 (up from 100) or less workers to fire their employees without any prior government approval, leading to insecurity about the tenure of work amongst the workers, putting them in a constant state of dilemma.
The effective implementation of these recommendations is crucial for harmonizing the diverse state rules and achieving the intended objectives of the new labor codes.
